Terms
Lootable is a local marketplace, not a guaranteed transaction service. These terms set the rules for using the platform, posting content, using trust features, buying or selling locally, and accessing any paid features that may be offered.
You must be at least 18 years old and legally able to enter into a binding agreement to use Lootable. If you use Lootable for a company or organization, you represent that you have authority to bind that entity to these Terms.
You are responsible for your account, device security, and anything that happens through your account unless caused by our own misconduct.
Lootable is a platform for users to discover listings, local sale events, and communicate about possible transactions. Lootable is not the seller, buyer, broker, dealer, consignor, insurer, shipping carrier, inspection service, or escrow service for user-to-user deals unless we expressly say so in a separate written product flow.
Users are solely responsible for deciding whether to interact, negotiate, inspect goods, test-drive vehicles, exchange funds, transfer title, transport items, or complete a transaction.
You are solely responsible for content you submit to the platform, including listings, local sale events, photos, proof photos, descriptions, pricing, tags, messages, offers, and reviews.
You retain ownership of your content, but you grant Lootable a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify for formatting and safety review, display, publish, distribute, and use that content to operate, improve, market, secure, and enforce the service.
This license survives for a commercially reasonable time after removal to support backups, legal compliance, disputes, fraud review, recordkeeping, and safety operations.
You may not use Lootable to break the law, exploit the platform, deceive others, or interfere with the service.
We may provide messaging, saved searches, alerts, reviews, reporting, blocking, proof-photo flows, trust summaries, and verification indicators. These tools exist to support the marketplace, not to create guarantees.
We may monitor, label, delay, hold, remove, or restrict content and features when needed to protect users, the platform, or our legal interests.
Meetups, inspections, item handoffs, and travel to or from transactions are at your own risk. You should use good judgment and follow platform safety guidance.
If Lootable offers premium subscriptions, early-access features, promotion credits, listing boosts, or other paid services, the pricing and billing terms shown at checkout will apply in addition to these Terms.
Except where required by law, fees are non-refundable, paid visibility does not guarantee impressions or sales, and benefits may be changed, suspended, or revoked if we detect abuse, fraud, or policy violations.
Your use of Lootable is also subject to our Privacy Policy. No internet service is completely secure or always available, and no local transaction can be made risk-free through a platform alone.
We may investigate conduct that appears to violate these Terms, our policies, or applicable law. We may remove content, preserve evidence, disable features, downrank content, suspend or permanently ban users, and cooperate with regulators, law enforcement, insurers, rights holders, or courts.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOTABLE PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" AND DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL CODE, OR THAT USER CONTENT, TRUST SIGNALS, REVIEWS, OR TRANSACTION OUTCOMES ARE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOTABLE AND ITS AFFILIATES, FOUNDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, PROPERTY DAMAGE, OR TRANSACTION LOSSES ARISING OUT OF OR RELATING TO THE SERVICE OR USER TRANSACTIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID TO Lootable IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend, indemnify, and hold harmless Lootable and its affiliates, founders, officers, employees, contractors, and service providers from claims, disputes, liabilities, damages, losses, and expenses arising out of your content, listings, local sale events, transactions, violations of law, infringement, fraud, or breach of these Terms.
Before filing a formal claim, please contact legal@lootable.io so we can try to resolve the issue informally. If a dispute cannot be resolved informally within 30 days, then, to the extent permitted by law, you and Lootable agree to resolve disputes through binding individual arbitration instead of court, except for small-claims matters and claims for injunctive or equitable relief involving intellectual property, platform abuse, fraud, or unauthorized access.
You and Lootable each waive any right to participate in a class action, class arbitration, or representative proceeding. If you do not want arbitration, you may opt out by emailing the legal contact above within 30 days after first accepting these Terms, including your full name, account email, and a clear opt-out statement.
We may update these Terms from time to time. If changes are material, we may provide notice through the service, by email, or by other reasonable means. Your continued use of Lootable after the updated Terms take effect means you accept them.
